Abstract

Judicial dossier concerning Zhang Chunshan (張春善, also known as 張根), a 35-year-old man prosecuted in Shanghai in 1944 in connection with the suicide of his wife, Chen Miaozhen (陳妙珍). Although the archival case cover classifies the matter broadly as 殺人 (killing), the first-instance judgment specifically found Zhang guilty of 教唆他人使之自殺 (inciting another person to commit suicide) and sentenced him to two years' imprisonment. The dossier documents the circumstances surrounding Chen Miaozhen's death following serious domestic conflict, together with the investigation of Zhang's responsibility for encouraging or inducing her suicide. It contains interrogations of the accused and witnesses, prosecutorial documents, evidentiary records, first-instance proceedings and judgment, appeal documentation, court summonses and release or custody forms. The case proceeded on appeal before the Shanghai High Court; the appellate judgment records 上訴駁回 (appeal dismissed), thereby leaving the original conviction in force. Subsequent procedural and prosecutorial documents continue through late 1944.

The dossier contains unusually substantial medical evidence. Documents dated 14–19 June 1944 include prescriptions and blood-serology examinations from private and municipal medical laboratories, while later material includes chemical analysis of substances and specimens connected with the case by the Shanghai Municipal Laboratory. These records were incorporated into the police inquiry into the circumstances and possible motives surrounding Chen Miaozhen's suicide. The first part of the archival dossier continues the case through prosecution and trial: Zhang was convicted of 教唆他人使之自殺 and sentenced to two years' imprisonment; his subsequent appeal was dismissed.

Comment

Extensive criminal-court dossier rather than a routine police suicide investigation. The archival cover uses the broad classification 殺人, but the legally more precise characterization established by the judgment is 教唆他人使之自殺. Zhang Chunshan is also recorded under the name 張根. The file is particularly valuable because it contains extensive handwritten interrogation and witness testimony concerning marital relations, domestic conflict, the circumstances preceding Chen Miaozhen's suicide, and the judicial assessment of responsibility. It also preserves both first-instance and appellate proceedings. The appeal was dismissed, confirming the two-year sentence. R43-2-4685_1 is the first digitized segment of the R43-2-4685. archival file.

R43-2-4685_2  is particularly important because it preserves the police-investigation phase that precedes the court proceedings contained largely in part 1. It includes repeated interrogations of Zhang Chunshan (張春善/張根), relatives and other witnesses; police reports and arrest documents; medical prescriptions and laboratory examinations; chemical analysis; and evidentiary records.

The archival classification 殺人 is broader than the legal offense ultimately established. For cataloguing purposes, 教唆他人使之自殺 / 教唆自殺 is the more precise description. The death itself was by poisoning (服毒自殺), and the file devotes considerable attention to the couple's medical history and marital conflict. Because the surviving medical documents include records relating to more than one person and several different laboratories, individual test results should not be interpreted as diagnoses without matching each report carefully to its named patient. The dossier is therefore particularly rich for studying the intersection of suicide, domestic relations, medicine, policing, and criminal responsibility in wartime Shanghai.
