Dead Bodies and Forensic Science: Cultures of Expertise in China, 1800-19492012Asen, DanielEnglishIn late imperial China the forensic examination of dead bodies in homicide cases was a
sophisticated field of technical practice which developed through the collaboration of coroners,
legal specialists, and literati-officials. After the fall of the Qing empire (1644-1911), successive
governments of the Republican period (1912-1949) adopted the late imperial state’s technologies
of forensic examination in their attempts to institute a modern court system. This dissertation
investigates the process through which modern police, coroners, legal officials, laboratory
scientists, and urban publics debated, reimagined, and ultimately accepted this long-standing
field of technical practice as a foundation for the modern Chinese state and its legal order.
The first half of this dissertation examines the forensic practices of the Qing empire and
the ways in which they were integrated into Republican statecraft after 1912.

Chapters One and Two argue that the late imperial bureaucracy successfully implemented a centralized system of forensic examination that shaped the ways in which coroners and local officials throughout the empire inspected dead bodies, analyzed causes of death, and documented their findings. Relying on the wide distribution of minimal amounts of forensic knowledge and skill, this arrangement made possible high degrees of consistency in examination practices while facilitating central authorities’ bureaucratic supervision over local forensic cases. While the “expertise” of individual coroners could become important under certain circumstances, it was not necessary for the legitimation of forensic evidence or knowledge in routine homicide cases. Rather, the bureaucracy expected that officials and coroners would simply follow official procedure, a way of legitimating inquest findings that could be used effectively across local jurisdictions despite uneven levels of forensic knowledge and skill among local officials and coroners.

Chapters Three and Four turn to the important role that these forensic practices played
in Republican Beijing for the dual projects of administering the city and constructing a modern
court system. Through a case study of the forensic work of police, coroners, and judicial officials
in the city and around north China, these chapters argue that by adopting the bureaucratized
examination practices of the late imperial state, the Republican court system facilitated modern
procurators’ professional jurisdiction over a crucial area of the administration of justice while
facilitating the integration of forensic evidence and judicial investigation. It is in this sense that
coroners and their forensic practices came to play a crucial role in the emergence of a modern
legal order.

The second half of the dissertation explores the ways in which new conceptions and
practices of scientific expertise were reconciled with the older, yet still authoritative, practices of
late imperial forensics. Chapter Five explores the ways in which a new discourse of professional
knowledge and expertise based on conceptual distinctions between “experience” and “theory”
led to a complex reconceptualization of the epistemological status of late imperial forensic
knowledge. While this new discourse served to legitimate new forms of forensic expertise based
on scientific medicine, it also provided coroners and others invested in late imperial forensic
practices with possibilities for reimagining older conceptions of knowledge in new,
epistemologically authoritative ways.

Chapters Six and Seven turn to the ways in which anatomic-pathological dissection and
laboratory science were integrated into the forensic investigation of deaths in Republican judicial
practice. Chapter Six argues that the implementation of forensic autopsies in Republican
Shanghai and, to a lesser extent, Beijing did not in fact challenge judicial officials’ and coroners’
professional authority over the forensic inspection of dead bodies.
Chapter Seven examines the ways in which a new community of medico-legal
scientists in 1930s Shanghai and Beijing attempted to extend their forensic expertise from the
laboratory into local courtrooms. By tracing the itineraries of the physical evidence examined in
the first medico-legal laboratories, this chapter shows that the local officials and coroners who
collected the evidence for testing played a crucial, albeit contested, role in the establishment of
legal medicine in China. Chapter Eight turns to the ways in which coroners themselves made use
of modern science to legitimate their own, older forensic practices. By exploring the ways in
which legal officials, coroners, and medico-legal scientists made use of popularized science in
their attempts to update late imperial forensic practices, this chapter demonstrates that “science”
had diverse meanings, could legitimate disparate forms of knowledge and expertise, and could
support different professional causes – not simply that of professional legal medicine.
Far from passive objects of forensic examination, the dead bodies that populate this
dissertation are active agents: they challenged examiners with mysterious wounds, ambiguous
anatomy, or the tendency to decay away along with the evidence. As sensational objects of
media coverage or simply reminders of the unjustly dead, the cultural and social meanings of
corpses influenced the actions of those who examined them, demonstrating in the process the
dialogue that science always maintains with culture and society. By foregrounding the ways in
which “experts” of all kinds engaged with the material challenges and legal and cultural
meanings of the dead body, this study demonstrates the dynamic interrelatedness, or coproduction, of experts and objects of expertise, of social power and natural knowledge, and of
statecraft and science.

Décentralisation et environnement en Chine2012Xiong, HangFrenchIn the literature, debate around environmental federalism is lasting and inconclusive. China has followed the global tendency of decentralization and has adopted a de facto environmental federalism. In this broad and diverse country, local knowledge and expertise is necessary to develop proper solutions for many environmental problems with local and regional nature. However, despite the adopted de facto environmental federalism, dramatic environmental crises and policy failures widespread in China. In particular, more recently, this country has seen arise many problems predicted by the opponents of decentralization. It appears that, contrary to the fiscal decentralization which has been a "helping hand" in resource mobilization and economic growth at the sub-national level, the decentralization of environmental policy implementation has rather been a "grabbing hand" in environmental management. With the purpose of providing a better and detailed understanding of the de facto environmental federalism in China, this thesis follows the different critics in the literature and test empirically for each of them in the Chinese-specific context. In summary, empirical results found in this thesis support the existence of problems related to environmental externality, strategic interaction and politically incentivized environment-sacrificing behaviors. Moreover, the current fiscal decentralization is likely to strengthen the capital-competition driven inter-provincial interaction; fiscal imbalance is more environmentally detrimental in poor provinces. These findings call for a "new environmental federalism" and a reform of incentives, in order to transform the Chinese de facto environmental federalism from a "grabbing hand" to a "helping hand" for better environmental governance.
Domination, institution, et identité : le mouvement Taiping et la Chine du XIXème siècle1992Gautier, GérardFrenchLa révolte Taiping, qui éclate en Chine en 1851, y fonde un Etat se réclamant du christianisme, écrasé en 1863. L'hypothèse de base de l'étude est l'existence d'un cadre d'interprétation souple des faits sociaux ("paradigme") au moyen duquel lettrés et couronne chinois exercent et légitiment une domination se reproduisant par l'intermédiaire de la culture et de la définition d'une conscience paysanne dominée. La première partie décrit la société chinoise avant la révolte, puis examine la mise en oeuvre de cette domination culturelle. La seconde décrit la révolte, insistant sur les interprétations successives de la Révélation Divine au moyen desquelles, au travers de luttes internes pour le pouvoir, se construit progressivement un paradigme hétérodoxe. Dans la troisième partie, psychologie du rituel, ambiguïté des symboles dominants, possibilités objectives et subjectives de résistance et de révolte et importance et limites de la religion dans une dynamique d'émancipation sont abordées. Le messianisme apparaît comme le paradigme typique des mouvements d'opposition dans les sociétés "précapitalistes" complexes. Puis une matrice d'analyse de tels mouvements en trois moments dialectiques inspirés de Laplantine: transe, messianisme et utopie, est proposée, et mise en rapport avec les moments de l'institution proposés par Lourau. Un schéma d'évolution est dessiné, impliquant une normation progressive du sens et une "dogmatisation " du paradigme. L'étude globalement concerne les conditions culturelles de la dréativité sociale (instituant) et de son institutionnalisation dans le cadre de la Chine impériale tardive, avec l'idée que certains éléments dégagés dans l'étude pourraient se retrouver dans d'autres cultures.
Droit au délogement et protection du patrimoine : Xiangyuan Lu et Gujia Lu, deux projets de rénovation dans la Vieille Ville de Shanghai (2003 - 2009)2010Zhang, KaiFrenchDepuis les années 1990, Shanghai a amorcé une période ultra-rapide de rénovation de son centre ville urbain historique. A première vue, de tels projets de rénovations à grande envergure ont directement engendré la destruction massive de quartiers historiques entiers, et à leur place, un la construction d'ensemble élevés est venue envahir ce même centre ville. Avec cette mutation du paysage urbain ont eu lieu les travaux de relogements des habitants initiaux des vieux quartiers, en même temps que l'arrivée de nouveaux habitants de classes sociales élevés. Comment est-ce que sous un régime politique socialiste, les autorités publiques ont été amenés à autoriser la réalisation répétitive de telles absurdités urbaines? Comment est-ce que ce régime qui gouverne les projets de rénovation des vieux quartiers va-t-il influencer l'espace urbain historique de la ville, ainsi que ses structures sociales? La présente recherche propose de décrire et d'analyser l'évolution de deux projets de rénovations urbaines au sein de la Vieille Ville de Shanghai, à partir de l'observation des dynamiques microsociologiques sur les deux quartiers concernés durant six années consécutives. Il s'agit des deux quartiers avoisinants de Xiangyuan Lu et Gujia Lu au sein de la Vieille Ville de Shanghai, le premier étant réalisé par un promoteur immobilier public, tandis que le second par un promoteur immobilier privé. Cette recherche a pour objet principal l'analyse des rôles des divers acteurs impliqués dans ces deux projets, à savoir les autorités municipales, les promoteurs immobiliers, les habitants, et les professionnels concernés, ainsi que les interactions entre ces acteurs. La recherche va ainsi comparer ces projets au niveau de leur mise en œuvre car par deux types de promoteur immobilier intrinsèquement différents, et tenter de dévoiler quelles sont les raisons initiales derrière de telles mutations contradictoires au niveau de l'ancien espace urbain, et au sein des structures sociales de ces anciens quartiers. Les six années d'historique de ces deux projets coïncident justement avec une période de transition de la gestion de l'urbanisme à Shanghai, où de nouvelles politiques de délogement, de planification urbaine et de logement sont apparus, en même temps que plusieurs événements importants qui ont grandement influencé le régime qui gouvernait les projets de rénovation des anciens quartiers. En d'autres termes, la société contemporaine a pu faire part de ses réactions vis-à-vis de ces diverses situations contradictoires lors des rénovations des anciens quartiers, obligeant ainsi l'Etat et les autorités compétentes à devoir réformer le régime actuel. Les mutations qu'ont vécues ces deux projets, ainsi que la lenteur à laquelle ils ont été mis en œuvre, font que les deux quartiers concernés sont toujours dans une situation stagnante difficile, où les chantiers de construction n'ont même pas pu encore débuté. Une telle image d'immobilité semble même remettre en cause la réputation de la " vitesse chinoise " en matière de construction moderne urbaine: pour les projets rénovation d'anciens quartiers, les choses ne dérouleraient plus beaucoup moins de facilité. Un autre objectif de cette étude, est de tenter, à travers l'analyse de tels processus de mutations, en observant ces différentes manières dont les promoteurs immobiliers et autorités municipales ont chacun gérer ces processus, de dessiner une nouvelle trajectoire plausible pour les futures projets de rénovations de quartiers historiques à Shanghai. Dans cette thèse, j'ai interprété le terme " délogement " mais pas " relogement " pour traduire le processus de " Dongqian " (动迁). J'ai d'abord beaucoup hésité entre " relogement ", " déplacement " et " expulsion ". La difficulté réside dans la différence entre deux objets dans un processus de " Dongqian ", y compris les logements à acquérir (à démolir ou à réutiliser après) et les habitants à déplacer. Les interventions qui concernent ces deux objets sont également totalement différentes entre elles. Il me faudrait trouver un mot concernant non seulement l'acquisition du logement avec négociations de compensation entre le promoteur et les habitants ayant un droit de propriété ou d'usage, mais concernant aussi le relogement immobilier ou financier. J'ai donc utilisé le terme " délogement " pour essayer de combiner les sens de " démolition ", de " déplacement " et de " relogement ". Il est vrai que dans la plupart des cas de rénovation urbaine en Chine, la proportion des bâtiments à conserver et à réutiliser est très faible. La démolition et la reconstruction sont des actions majeures d'un " Dongqian ".
